Disability RetirementFederal Employee Disability Retirement AttorneysFederal employees have a complicated retirement scheme. If a federal employee becomes disabled, but is too young to qualify for regular retirement, they have the right to apply for disability retirement. This differs from workers’ compensation (workman’s comp) because the disability does not necessarily have to occur during the course of employment. The lawyers at Mahoney & Jeffrey have been helping disabled federal employees for over 13 years. In fact, we charge our clients reduced hourly rates in order to further the non-economic goal of assuring legal representation for everyone attempting to enforce individual, civil, and Constitutional rights. If you are a federal employee and you believe you may be eligible for disability retirement, call Mahoney & Jeffrey today for a case evaluation. What to expect when you apply for disability retirementAlmost every federal employee has the right to apply for disability retirement. In order to get disability retirement, the employee must prove that they have a disability that will last at least at least a year and prevents them from providing efficient government service. The disability must be severe enough that it cannot be accommodated in their current position, or in a vacant position at the same pay grade level. The employee or their representative submits the application for disability retirement to the employing agency or, if the client is no longer employed by the federal government, to the Office of Personnel Management (OPM). The OPM considers the application, then accepts or denies the request. If OPM denies the request, the next step is to seek OPM reconsideration. If that is unsuccessful, the employee may appeal to the Merit System Protection Board (MSPB). If the MPSB turns down the application, the next appeal would go to the U.S. Court of Appeals for the Federal Circuit. Mahoney & Jeffrey represents employees from disability retirement application through appeal.
